of our Clients. We have put these "Up Front Criteria" in place to let you know what you may expect from us. It is our firm belief that the "Fine Print" should be clearly presented and understood by both parties involved in this Agreement.

reserves the right to suspend or cancel any Account for
inappropriate conduct or abuse of the server.

Availability
866GetHost.com
will do everything in its power to maintain availability of your
website. You should be aware, however, that a minimal amount of
down time can be expected. Scheduled Network maintenance outages
will be necessary to upgrade hardware and software applications.
All scheduled maintenance will be posted on http://www.866GetHost.com.
Unplanned outages can occur without notice, and can be the result
of many reasons. These range from hardware problems to regional
internet outages. You must understand that in these cases, the
service may not be available to you. If you can not reach your
website, you should contact Support@866GetHost.com. We use the website monitoring
services of Website Availability to check all our main web hosting
servers every 5 mins. This means we check your site, so we know
when it is down within Five (5) minutes of an occurance. We always work
hard to make insure that down time is kept to a minimum.
2.
Traffic & Storage
866GetHost.com
provides the storage space and bandwidth in conjunction with the
hosting package the customer has selected. The type of package chosen,
must reflect the activity that the site uses. If the Clients
website exceeds the capacity of the hosting package, the customer
must modify his website to become compliant with the bandwidth
and storage capacity, upgrade to the level of hosting to accommodate
the needs of the clients website, or pay for additional services.
All website data must conform to the Internet standards (html
pages, .gif .jpg etc)
3.
Content
Clients may
not make use of their service to break any local, state or federal
laws. Transmission, storage, or presentation of any information,
data or material in violation of any of the above stated laws
is prohibited. You agree that 866GetHost.com may remove
any information that it finds or is reported to be unlawful. You
also understand that 866GetHost.com may terminate your
account if it feels that your information is unlawful, obscene,
or prejudice to others. You may not in anyway send unsolicited
bulk e-mail, material we interrupt as threatening, or SPAM. By
spaming you will automatically terminate your service with 866GetHost.com.
4.
Restrictions
- The website
shall not be used to store pornographic material. Sites containing
adult material, specifically, depicting obscene nudity or sex
related acts are prohibited. Professional photographers who
are using the web to promote their businesses may be hosted,
however, 866GetHost.com must deem the content appropriate and
in good taste. 866GetHost.com reserves the right to make the
final decision on what is allowed to be hosted on our servers.
- No hosting
of MP3 files or copyright material, unless you are the copyright
owner.
- These
servers may NOT be used for the sending of unsolicited e-mail
(spam). We have a strict policy of not hosting any sites that
participate in "spamming". This includes Email, Newsgroups,
ICQ or any other form.
- No site
selling or promoting bulk email is allowed
- No content
or links promoting WAREZ, Irc Bots, Pirated Software allowed
- The Web
site shall not be used for gambling or any other practice deemed
illegal by the laws of Canada.
- The Web
site shall not be used to store or disseminate material of a
threatening or slanderous nature.
- 866GetHost.com
reserves the right to deactivate any Account at any
time, if the Account is in violation of any 866GetHost.com operational
procedures.
- Billing
begins when your server is configured and on-line. It is the
responsibility of the Client to arrange for Website Design Services. Website
Design is not included in the setup charge, or the webhosting
charge. If you require Website Design Services, please send an email
to Webmaster@866GetHost.com
- Virtual
Server fees do not include the registration of a Domain Name.
We recommend 866GetDomains.com for Domain Name Registration, Renewals & Transfers.
- With the exception of Annual Prepaid Accounts, Client understands
that the 30-Day Money Back Guarantee only applies to monthly
charges paid, and does not include setup charges.
- With the exception of Annual Prepaid Accounts, Client may
cancel your server at any time however you must email Billing@866GetHost.com
to cancel your service. The eMail Cancellation Request MUST come
from the Billing eMail Address that is on file with our Billing
Department. Cancellations are done on the last day of the month
the Cancellation Request is submitted. Due to the variety of arrangements with our various upstream providers Annual Prepaid Accounts are exempt and fully Non Refundable. If Client has questions or concerns regarding this type of Remittance, please make sure to Contact.Us PRIOR to selecting this type of Settlement Option. Sorry: No Exceptions!!
5.
Payment Policy
Payment for services are due in full on or before the First (1st) day of each Month. The Client remains responsible for any and all
monies registered on his/her account as soon as the account is
established and setup right through to the account being closed.
Websites and email accounts will be suspended for non-payment
by the 7th day of the month if either a) credit cards fail to
process in that time or b) a check or money order has not been
received by our Billing Department by that date. In order to close
an account, it is important to understand that these requests
must be in writing. No other method of closing an account will
be accepted. Closing an account must be received and time-stamped
prior to the current month in order to avoid being charged for the
subsequent month/s.
6.
Credit Card Payment
Accounts that
have chose to pay via credit card will automatically be charged
the first of each month, to the credit card on file, unless 866GetHost.com
is notified prior to the start of the next month. It is the responsibility
of the customer to ensure that their credit card is current to
avoid any disruption in service. All credit card charges will
appear on your bank statement as WP-ADD IDEAS GROUP LTD.
The client is responsible for any fees associated with the use
of the credit card in the event of any chargebacks etc. To avoid
interruption of service, all credit cards must clear before the
7th day of the month.
7.
Payment via Check
Accounts that
are making payment via check, must ensure that there monthly payment
is received PRIOR to the First (1st) of the Month. Any NSF checks
will be subject to a $25 service charge. Accounts must be paid
within the first 7 days of the month to avoid suspension and/or
possible Account Termination.
8.
Cancellation
866GetHost.com
reserves the right to terminate webhosting services of any Client
who is in violation of the terms and policies. We reserve the
right to terminate immediately the service at anytime without
notice, for illegal use, sites abusing server resources, or any
site that is having a negative impact on the server and/or other
clients on the server. No refunds are given in these instances.
9.
Changes
The policies,
terms and agreement of your service may change from time to time.
Any and all modifications to the services offered will be posted
on this website. You will have 14 days from the day of the posted
change to be bound by the policies

will not be responsible for any damages your business may suffer.
866GetHost.com makes no warranties of any kind, expressed
or implied for services we provide. 866GetHost.com disclaims
any warranty or merchantability or fitness for a particular purpose.
This includes loss of data resulting from delays, and any and
all service interruptions caused by 866GetHost and its
employees. 866GetHost.com reserves the right to change
or update policies without notice.
